1. About GAGcars

GAGcars is an online marketplace that connects vehicle buyers and sellers. GAGcars provides a platform for advertising and discovering vehicles, spare parts, and automotive services.

GAGcars is not a vehicle dealer, importer, exporter, broker, agent, auctioneer, escrow service, financial institution, insurer, mechanic, or transportation company unless expressly stated in writing.

2. Eligibility

You must:

• Be at least 18 years old.
• Have legal capacity to enter contracts.
• Provide accurate and truthful information.
• Comply with all applicable laws.

GAGcars may refuse or terminate access to anyone at its sole discretion.

3. User Accounts

You are solely responsible for:

• Maintaining account security.
• Keeping passwords confidential.
• All activities performed under your account.
• Updating your information.

GAGcars is not liable for unauthorized access caused by your negligence.

4. Marketplace Disclaimer

GAGcars only provides an advertising marketplace.

We do not:

• Own listed vehicles.
• Inspect vehicles.
• Verify mileage.
• Guarantee ownership.
• Confirm accident history.
• Guarantee prices.
• Guarantee financing.
• Guarantee vehicle condition.

All transactions occur solely between buyers and sellers.

5. Buyer Responsibility

Buyers must independently verify:

• Ownership
• Vehicle condition
• Accident history
• Chassis/VIN
• Engine number
• Registration documents
• Import documents
• Tax status
• Roadworthiness
• Mechanical condition
• Service history

Failure to perform due diligence is entirely the buyer's responsibility.

6. Seller Responsibility

Sellers warrant that:

• They have legal authority to sell.
• Listings are truthful.
• Images belong to them or are authorized.
• The vehicle is not stolen.
• There are no undisclosed legal disputes affecting ownership.
• All pricing is accurate.

False listings may result in immediate removal, suspension, and legal action.

7. Listing Fees

Listing fees are non-refundable except where required by law.

Payment does not guarantee:

• Sale of a vehicle
• Number of inquiries
• Visibility
• Traffic
• Buyer interest
• Revenue

GAGcars may revise pricing without prior notice.

8. Featured Listings

Featured listings improve visibility only.

GAGcars does not guarantee:

• Sales
• Faster transactions
• Higher offers
• Better rankings outside featured placement

9. Prohibited Activities

Users must not:

• Post stolen vehicles.
• Upload false information.
• Impersonate another person.
• Use bots or automated systems.
• Spam users.
• Manipulate prices.
• Commit fraud.
• Launder money.
• Advertise illegal goods.
• Upload viruses.
• Interfere with Platform operations.
• Circumvent payment systems.
• Harass users.

Violation may result in permanent suspension without notice.

10. Verification

Verification badges indicate only that certain documents have been submitted and reviewed.

Verification is not a guarantee of:

• Trustworthiness
• Honesty
• Vehicle quality
• Vehicle ownership
• Future conduct

Users must still perform independent verification.

11. Communications

By using GAGcars, you consent to receive:

• Emails
• SMS
• Push notifications
• Calls
• Marketing communications
• Service announcements

You may unsubscribe from marketing communications where permitted.

12. Intellectual Property

All rights relating to GAGcars, including:

• Logos
• Brand names
• Software
• Design
• Graphics
• Source code
• Databases
• Content

remain the exclusive property of GAGcars and its licensors.

No rights are transferred to users.

13. User Content

Users retain ownership of uploaded content but grant GAGcars a worldwide, royalty-free, perpetual, transferable, sublicensable license to:

• Display
• Store
• Copy
• Publish
• Promote
• Translate
• Modify formatting
• Market listings

for purposes of operating and promoting the Platform.

14. Fraud Warning

GAGcars strongly advises users:

• Never send money without inspection.
• Never share banking passwords.
• Meet in safe public places.
• Verify ownership documents.
• Inspect vehicles before payment.

Users assume all risks associated with transactions.

15. Payments

Payments made through the Platform may be processed by third-party payment providers.

GAGcars is not responsible for:

• Banking delays
• Payment failures
• Exchange rate fluctuations
• Card issuer decisions
• Third-party payment interruptions

16. Third-Party Services

The Platform may contain links to third-party websites or services.

GAGcars has no responsibility for their:

• Content
• Security
• Privacy practices
• Accuracy
• Availability

17. No Warranty

The Platform is provided "AS IS" and "AS AVAILABLE."

To the maximum extent permitted by law, GAGcars disclaims all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy
• Reliability
• Availability
• Continuous operation

18. Limitation of Liability

To the fullest extent permitted by law, GAGcars, its founders, shareholders, directors, officers, employees, contractors, affiliates, investors, agents, licensors, successors, and assigns shall not be liable for any:

• Financial loss
• Vehicle defects
• Lost profits
• Lost opportunities
• Fraud by users
• Identity theft
• Personal injury
• Death
• Property damage
• Data loss
• Business interruption
• Consequential damages
• Punitive damages
• Incidental damages
• Indirect damages

Our maximum liability shall never exceed the amount you paid to GAGcars during the twelve (12) months immediately preceding the claim.

19. Indemnification

You agree to defend, indemnify, and hold harmless GAGcars, its founders, owners, directors, shareholders, employees, affiliates, successors, and agents from any claims, damages, liabilities, losses, judgments, costs, penalties, or legal expenses (including reasonable attorney fees) arising from:

• Your use of the Platform
• Your listings
• Your transactions
• Your breach of these Terms
• Your violation of any law
• Your infringement of third-party rights

20. Suspension and Termination

GAGcars may suspend, restrict, or permanently terminate any account without notice for any reason including suspected fraud, abuse, policy violations, legal requirements, or conduct that may harm the Platform, its users, or its reputation.

No refunds will be issued following termination for violations.

21. Privacy

Your use of GAGcars is also governed by the GAGcars Privacy Policy.

22. Force Majeure

GAGcars shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, pandemics, war, terrorism, civil unrest, strikes, internet outages, cyberattacks, government actions, utility failures, or acts of God.

23. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Ghana, without regard to conflict of law principles.

Any disputes shall be submitted to the competent courts of Ghana unless GAGcars elects to resolve the matter through arbitration or another lawful dispute resolution mechanism.

24. Changes to These Terms

GAGcars may amend these Terms at any time.

Updated Terms become effective immediately upon publication unless otherwise stated.

Continued use of the Platform constitutes acceptance of the revised Terms.

25. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

26. Entire Agreement

These Terms constitute the entire agreement between you and GAGcars regarding use of the Platform and supersede all prior communications or agreements relating to the Platform.
